I think the difference is that it's "bigger" but there's less unique stuff to do this time. Episode 11 had both an entire vacation to build that is completely missable on half the LI paths for instance.
This time most of the variation seems to be within existing scenes you'd see anyway (i.e. LI scenes within the NYE party) so seems to have a more rational workflow that doesn't require completely new design work to accommodate it.

It's not so much about whether he has the right to control their relationships, and more a bro code thing. Speaking generally, dating a friend's ex can get pretty awkward - especially if they had a tumultuous relationship the way Tremolo and Zoey did. I think asking was the right call, because it's very likely given the circumstances of their breakup that he wouldn't really be comfortable with her hanging around all the time and being with one of his friends - regardless of whether he's already dating someone else or not.
That said, the good karma of asking before taking his shot is kind of immediately ruined by trying anyway, regardless of Tremolo's response. It's not that he has to respect the guy's wishes over his own feelings, but at that point all you were really doing was trying to ease your own conscience and you didn't actually care about the answer. Which is kind of shitty.
I don't think they would've ended up banging even if Jacob had outright told her the MC still has feelings for her. Remember that she didn't really understand her own feelings at the time, and freaked out and ran into the woods when Tremolo told her she was his first love; this is foreshadowed in the episode's introduction, so it wouldn't really make sense if one of the possible outcomes was the two of them getting back together right then and there.
What bothers me about the choice is that, narratively, it doesn't really matter all that much. No matter what you say, the same event still occurs and goes exactly the same way in that moment.
What I'd have loved to see is, if you ask him not to, Jacob respects that and holds back... for now. He can't stop himself from feeling how he feels, of course, but he respects his friend enough to not just immediately go and do something he was specifically asked not to. Instead, if you ask him not to make a move he does so at the Christmas party; the feelings haven't gone away, and seeing her walk around in some very sexy lingerie is just too much for him to resist. Maybe at that point if Tremolo is already committed to someone else or has shown absolutely zero interest in her she takes Jacob up on the offer, or maybe she just always turns him down. But I think that would've been a much more narratively sensible order of events than the exchange going:
"Hey man, can I ask your ex out?"
"I'd prefer you didn't."
"Oh, okay, that's cool."
Ten minutes later...
"Hey baby, wanna fuck?"

Yeah, dude. Was doing a fresh playthrough hoping to reach ep 11 for few paths by Xmas. Wintter episodes playthrough is better when it is cold and not scorching summer.

If he does I don't remember it. But it's also been ages since I played that scene and actually asked him not to. Zoey is hot but I just don't feel any connection to her so I usually don't do her path. I've got one run with her for completionist's sake but that's it.

I usually tell him to go for it in my mg runs and to not go for it in my others runs, he only tries to kiss Zoey after you give him permission, at least in my runs I've never seen him try when you don't permit it.

I agree that asking for permission, getting rejected, and still trying is shitty behavior. But I don't understand why Jacob should even ask. Imagine if there was a girl in the game that you liked, but she had a past relationship with one of the Dicks. Would you ask for permission? And if you were told no, would you give up? Of course, it would be awkward to date the ex-girlfriend of a friend you've known since childhood. But the MC and Jacob are not that close. They can hardly even be called friends. In fact, they're just two guys who wear the same jackets and live in the same house.
Even if Zoey only realized her feelings in episode 11, she wouldn't have refused to have sex. If the MC had tried to kiss her during their conversation by the fire, she wouldn't have pushed him away, I'm sure of it. I don't mind the slow development, in fact, I even enjoy it, but what happens between the MC of the "other" branch and Zoey doesn't make sense in the context of the game. Considering how easily the MC got sex at the beginning of the game, I just can't accept the fact that Zoey returned 2 months ago and she still hasn't had sex with the MC. Dick MC and Dick Zoey were supposed to fuck already during Halloween. The only explanation I see here is: DPC did not want to further increase the branching and create an additional branch for Zoey if the MC is on the path of "others".

It's mainly a common courtesy/social grace thing. Even if we assume they're not friends and just "guys who live in the same house," Jacob dating Zoey would still likely mean her coming to the house to hang out with him, attending parties etc. Which can be very awkward for Tremolo depending on how he feels about her. Jacob isn't required to seek permission before asking her out, it's just the nice thing to do, and makes everyone's lives a bit easier.
I guess we'll have to agree to disagree here because I don't really feel the same way about anything you're saying here but it's also very subjective based on our own readings of the characters, so we'd just end up going in circles. The one thing I will say is that the notion that "she would've fucked him earlier but DPC didn't want to bother adding a route for her" is ridiculous, given that she did get a route. It's not like that was a rewrite based on popularity with fans - not only does DPC not give a shit what most people think, the general reaction to Zoey has been largely negative. Her inclusion in the game has always been part of the plan, since the first time she was brought up. So, no, the idea that she would've fucked him earlier but DPC was just too lazy to add her route doesn't hold water.
