I think patreon need to change the TOS so we can actually sue devs who milk money from people with "bugfixes updates"

I don't get the whole legality things when "promises" are involved, because anything inside of a tos can pretty much give anything in court a middlefingle and say suck my beloved shoulder blades.
We know where that was going to go.

the responsibility is no longer on the maker, and is no longer driven by other motivations of need and deliver.
