The guy is profiting, whether direct or indirect is irrelevant. In the eyes of the US legal system, where this would apply, it would be 100% viewed as copyright infringement since he is not only replicating characters from a well known franchise, but he's also receiving funds from an unofficial unsupported title.The game isn't being sold. The assets are likely downloaded from smutba.se, and are uploaded there from other users that made them on other programs, like blender, DAZ etc. Having a patreon to have fans fund a project isn't the same as illegal sale of IP owned by others. At best, EA can ask for a C&D, not an outright lawsuit. At least at first. But otherwise, it is no different than what every Blender/SFM animator is doing with DoA, Overwatch, Resident Evil, Stellar Blade, Marvel Rivals, etc.
I make no issue with it, personally. I'm just saying, I've seen developers pop up, make a game and then get told to stop or they'll be intercepted at legal level. Nothing new in the digital age.
