I really don't like it when people "confront" me like that with things I already talked about, but fine, I'll make an exception.

This has nothing to do with my lawyer or myself. The investigating police officer already checked my stuff, we don't know if they checked everything yet but we know that my stuff has been checked already. The investigating police officer thinks she found something incriminating on my phone, then started to look into my games, checked my SSD that only contains renderfiles for DAZ3D and says that, given the fact she only has access to 91x91 pixel big unrendered previews of characters and scenes, some of those characters look too young. This is why I'm not getting my stuff back at the moment, because she thinks ( and it's only her from what we know so far ) there is incriminating stuff on it. The procedure then is that the state attorney has to check if those files are actually incriminating, and then they either confirm or deny it. The second part didn't happen yet, my lawyer send multiple requests to get a statement of the state attorney regarding that and they have been ignored so far. There is two ways this can go. The state attorney says "no, this is fine, what the fuck, you can't make anything out on these pictures ( which is the likely case, if you ever worked in daz3d you know these thumbnails ) or they say "yeah, she is right." If this will be the case, we can go to a judge and they will have to make a decision which will most likely end up being in my favor.

The thing is, the state attorney has been "ignoring" our requests lately. Before Christmas my lawyer asked for an update on the case file, which has been unanswered. He asked again before easter, which was also ignored. After some digging and asking other lawyers ( and people that know stuff about the law in Germany ), this usually means there is nothing new in the case file and they don't think we need an update. Which is pretty fucking stupid to not just say so, but the don't have to say anything.

And to summarize how law enforcement works here: They take your shit and dump it in the chamber for at least 6 months, sometimes up to a year. Then they will mirror your harddrives ( they dont work with the original ), and check those mirorred copies of your harddrives/phone. This process is very time consuming, apparently, because they use fucking ancient software ( keep in mind that all of my PCs only had m2 ssds, so they might be even more slower because they dont know how to work with them etc ). Their software to look for incriminating stuff is ancient as well. From my understanding, it will detect nudity and then a police officer has to say "Okay, this is just a naked woman" or "Okay, this is problematic."

Heres the catch: None of my games feature anything that is even remotely illegal in Germany. I got a confirmation regarding this by several people that work as lawyers or have a good knowledge about the law. Even a character like Olivia, who a lot of people here think looks too young, would be fine to have a nude render of, since it's clearly visible she is fictional. The only exception would be if she would be in an obvious sexual render, like getting fucked or something. I don't have anything like that. The only thing I have is when you load characters into daz3d ( at least in my case ) they are "nude", doing a T-Pose ( they dont have genitals, just nipple textures ). And then it's like I said above, it's a 91x91 pixel unrendered thumbnail of the .duf file, if you ever worked in daz3d, you know that you cant make out shit there.

This has not been "short" but that's all you're getting. I'm getting kinda tired of explaining this over and over again since I talked about this multiple times in my progress updates and standalone posts as well.

And yes, sadly, when I don't give an update about the case in the progress update, then it means there is noterally nothing new. The last thing I got from my lawyer was on April 30th, where he just tells me state attorney didn't respond.

I don't want any pity but this is the most frustrating and emotionally draining thing ever. The fucking feeling of being powerless because some fucking person at the police department deems my stuff questionable and thinks she found something to have a case on my phone.

Accuse her of tardiness and incompetence. Explain that such a simple activity as checking the hard disk takes her a year and a half. I wish this would work in Germany, but when it comes to the police, they always have the longer reach here. This is something I can and will do once this whole shit is over and I had my court hearing etc, because then they can't do anything about it anymore. But for now my best course of action is to keep calm and wait for them to do "their work", which usually means she will keep digging and then end up being disappointed that I'm not some kind of extreme predator that will boost her career.

The other thing I can and will do is that you can report these police officers to their internal department and they will start an investigation. Even if it turns out she did her work correctly, she will not be considered for promotions etc. for at least 6 months.

There is nothing you can do, that is the worst part. Literally nothing. Like, you can try to sue them for inactivity but this usually takes a year or two just to reach the court. They will use the excuse that there is too much work and not enough state attorneys to do it.

Sadly, the police doesn't operate along the lines of "Innocent until proven guilty". In cases like this they are purely subjective ( even though they are not allwed to be ), because she works in a department ( I guess her rank is like a detective in america, in germany we call them kriminalpolizei ) that is only related for a cerain type of crime ( the worst kind ). I was always a strong believer that the police in Germany is working good and efficient, but now that I'm at the receiving end of their investigations I can say that belief was wrong.

There is a topic to check there, but we ( my lawyer and I ) should only act once I'm "in the clear". She can make my life so much harder if she wants, sadly. Though I'm pretty sure she already tried to get my games taken down from sites like patreon and Steam.

The fun part is, the longer it takes, the harder it will be for them to question potential witnesses ( if they have any ) in court, since 1 1/2 years already passed, people tend to forget stuff over time. So this can be "in my favor" in that regard. But they also have to get done with it eventually and I'm pretty confident it will be in the next few months. If not then I will come up with more questionable stuff to get my shit back... Or remake the characters. For that I need help from someone who is very skilled in recreating characters, though.

Since I work on the prequel I only have a set time in my head that I'm not going to share yet... But remaking the characters is the ultimate last resort that I will go back to.

I certainly hope your predictions come true, about the next few months part, partly because I miss the characters that were in the drive, but more because I want true justice to prevail, especially the kind of justice that is in spite of corrupt law enforcement. You have gone through enough of this, and I hope things become better for you in the end.
