Brother, this game is a game for adults, otherwise what could be the goal. The developer can put any scene similar to this in the game, including the pee and shit scene. If you don't want to play incest, you can turn to other games. There are many games you can play, no one forces you.
My opinion, this is Ellie's mistake, not the developer's. Maybe she was in a hurry, and before that Ellie had never used contraceptives - she too inexperienced. But I am sure that Nadia takes regular contraception, which will no help Ellie from pregnancy already.
