Played with and without the patch, both routes, tried all outcomes and the option to ask for Jay's approval never shows up for me neither.

You have to open one of the files in the game folder (forgot which one), then change one of the = false lines to true (again, don't remember which). Only then will you be given access to open it.

Think you can find the exact way somewhere on the forum, or with an online search engine.
