Depends on where you live. My understanding of UK law is that you have to prove you are losing money to a product to be sue. IE if Simbro's dev isn't making money off of it, someone else can pick up the slack.whats are the rules for taking on someone else's project. Take the 3D editor. You can use DAZ 3D or other platforms. For example, ILLUSION

I mentioned some engines, there is a large list of others. But if you want to make a 2D game using an outdated engine, then it is easier to take version 2.7 and continue. We do not need another 3D game imo. The fun of this game was mostly because of the unique 2D style and the possibilities that come with it.
