Real answer? It depends on the mod reviewing the ban report. You can find loli games here, for fucks sake there IS a loli and shota tag.
The example that I love the most is the happylambbarn one. You can have one of their loli games here (the loli dog one) but the other is a no no (tokiko's game) it's pretty damn funny when you think about it.
So probably mods just love to fap to this game and so they didn't take it down.

I believe it is more about legal cover for CP in the US.
If the game is on Steam and comes through a US publisher (Kagura) then someone else has done due diligence on it. Fan translations on the other hand, well that could get people in legal hot water.

Besides of the DLC, they are making a new version of Summer Memories iirc called Winter Memories.
It has a Demo out and is looking good as far as I can tell.

Joiplay version doesnt seem to be allowing for extraction its I have the app download but it says it can find anything to open the download
Excuse me, i'm currently using a chromeOs with Wine to play games, and I was happy to find that repacked versions of RPG MV games exist, but every time I open the executable nothing happens. Do you have any idea what it could be or am i being punished through having to use a chromeOs by some unknow entity?
edit: tried another repacked game and it didn't work either.
