Are you making this argument based on some kind of legal foundation, or are you just expressing your own opinion? Further, how would you objectively determine whether or not a project is "dead"? Since we can't know the future with 100% clarity, isn't the best we can say is that the project is on hold?
I don't think these guys are ever coming back, but I'd be careful about making this kind of blanket statement about IP law on the off chance that somebody might mistake your statement as being authoritative.
From my layman's opinion which is informed by an interest in IP law as it relates to music and some basic background reading of some law review articles, I'd venture to say that the issue is a bit more complex than saying that one could just pick up the project with the same models and be 100% sure that no exposure is attached.

I always check adult/porn gaming forums for professional legal advice. Do you listen to yourself? Really? You think a large subset of readers here are idiots that get their I.P. law knowledge from a game thread on a porn forum? Seeing people reenacting stupid viral social media stunts(check fraud) almost has me agreeing with that sentiment.

If you've been following this thread for a while (and MSN for that matter), there's plenty of discussion of what may or may not be constraining someone who had an eye on picking up the project or something similar. So yeah, for some people that is actually a topic of interest, and while it's not as universally interesting as actually playing the game it is interesting to me. Since I was being replied to, I wanted to clairfy whether the person responding was offering opinion or something that was more tangible . . . my fault for wanting to know things.
Don't know why you're insisting on inserting yourself in a conversation in which you claim to have no interest, and I am at a loss to figure out what I've ever said that you took offense with to the point that you'd be trying to mock me, but I just want to point out that not every post is specifically for you or about you.
