As I said, I don't really trust the MC's framing, especially at the start of the game. The fact that Allison doesn't debate his statement doesn't automatically make the statement valid.I mean they have been divorced for 2 years and MC asks for an example where Allie has shown him any affection in the last 5, but she can't. The festering had been going on for 3 years and neither did anything to remedy it. That sounds pretty dead to me.
But that aside, just because the two of them weren't really affectionate anymore doesn't mean they're as good as divorced. The two could have still gone through the motions in a more business-like manner, cooperating on official matters (Lily most obviously) but drifting apart otherwise. I wouldn't describe that as dead, though it clearly would die eventually, likely once Lily grew up.
To my mind, that's a very different situation from the MC not only starting an affair with a mutual coworker, but trying to brazen it out once Allison caught wind of it. YMMV.
