Yeah I guess a fetish for nude women is pretty rare to be honest. Not much interest in big ass, big titties ladies that I can see, so I guess it would be selfish to wish dev time on such niche content. First of all, never contemplate stealing intellectual property, not even jokingly. Second of all, it depends on what you're actually doing. If you mean like drawing something very similar to her, in your own style, I don't think that's a problem. Plenty of brown haired women in military uniforms. If you mean like tracing her picture, giving her picture a minor edit, or outright copying and pasting her picture, I'd strongly advise against it. Not only would you be susceptible to a copyright strike, it looks cheap, lazy, and dishonest.
I'm well aware. I will probably contact him. I made my comment, kinda offhandedly because I've been spending the last few months building up a visual reference for outfits. I'm not an artist myself, so just hiring an artist and telling them draw a sexy black shirt might come out with completely different results than I imagined. So I've been doing a lot of reference image hunting for clothing lately, and building character portfolio's that I plan to give to the artist to base each outfit from. This is fully legal and is widely practiced, so no worries here. Pic is an example of what I mean, since I am planning full body models including feet, these are some shoe designs I've been looking at for one character.
I really like this shoe cover and want it a separate item so you can have the girl wearing only these. I've never seen these in porn before either. So I have to wonder how far copyright reaches. If I see a picture of a nice shoes or a pair of panties and use that as inspiration for a new outfit, that's legal so long as the brand logo isn't included. So clothes aren't copyrighted to that degree. But if I see a nice clothing or outfit in a game, is that clothing now copyrighted because it's actually a digital asset and not clothing? Or does it only matter if the silhouette is recognizable? Like 2B's or a Stormtrooper outfit is iconic and part of a set, so that's harder to take one piece of it for inspiration. So that's why I wonder how much of her coat is copyrighted.
Her body type is not copyrighted. There are real women with her body type, so that's no problem. I'm not gonna call her Olivea. Hairstyle isn't copyrighted. Outfit 2 is literally just a jockey. Not copyrighted. Outfit 4 is a standard skank/stripper wear. Not copyrighted. Outfit 3, I'm not sure, probably based off something fancy he saw. The only thing that I think I'd need to get permission from tengsten is the outfit 1 military coat. That's the one I love the most. It fits so well. Yet it's probably based on something IRL too. I'd have to figure out what that is. I know changing a design 15% makes it legally distinct too, so if I can't find the source that tengsten was inspired by for the coat I could just change it a bit. But really, if I just asked him and offered some cross promotion deal, and had a small advertisement for ImpG in my project on the condition I can have Olivea and the Beastwoman as a rare guest character I wonder if he'd agree or not. It's worth a chance.
If worse comes to worse and nothing works out. Legally nothing can stop me from modding the game myself using the artists I hire for my own project. I can just add the second Olivea sex pose in a fan mod. All the assets for ImpG are under 720p and assets for my game are between 1440p and 4k so wouldn't be too expensive to ask my artist to draw some 720p assets up for a free mod.
I just think it's such a waste that out of all the main and extended cast. Chrisia, Olivea, Paula, Richard, Hana and Frida. Olivea is apparently going to be the only one without the sex pose. Such a dumb decision.
