So, with porn games, while yes, it is still technically copyright infringement to include those videos, the actresses in said videos gave written and legal consent to appear in and have their likeness used in those videos. Porn itself is also legal. With deepfakes, however, those are much more dangerous because, while the act of deepfaking itself isnt illegal, the usage of the actors likeness without permission, by technicality, is, and if the actor wanted, they could press charges. I don't think this is a very constructive response.Why don't you contact Patreon and ask why its worse?
Sure. But they did not agree to have their likeness used in Patreon games. They gave specific permission to appear in a specific video published by a specific company. They did not give blanket permission to everyone to use out-of-context clips of their work in their own games. They use images of celebrities without their consent (Sometimes even naked images) without any permission to use their likeness.Celebrities also have a public image to maintain, so the lawsuit could also be a claim towards defamation, which is much harder to dispute. If disputing the fact that it's their likeness isnt hard enough.
Paparazzi is legal in PUBLIC SPACE. When using means to take photos of someone in their "private sphere" (no public space), its not. About defamation. I think a defamation suit will only fly if it can be proven that people actually think this is the person in the video. For example, if Emilia Clarke wants to sue for defamation she needs to prove that the author of the game is saying it actually is her in the video.
In other words, if a reasonable consumer of this game boots it up and then sees a deepfake hardcore video of Emilia Clarke and thinks "Oh my god, I can't believe she did a hardcore porn video. She's a mainstream actor my opinion of her is changed." then it's defamation. However, if he thinks "Gee those deepfakes sure did come a long way. This really looks like Emilia Clarke. Though it's obvious to me it isn't actually her" then it's not really defamation.
And if you put a huge disclaimer at the start of your game saying "This is a work of fiction, all characters are imaginary and any similarity between appearance, names, places in the game and reality is purely a coincidence."
You significantly minimize the number of people who might have actually thought it is really the actual mainstream actor in the hardcore porn video. To the point where if someone does think this is really Emilia Clarke, it would be proper to call them unreasonable.
