This is one of my all-time favorite games! I'm sorry to hear the dev's personal life hasn't been going well but wish them well and hope the new found freedom will mean more time focused on awesome content.
Still hoping for a release by Christmas but, if not ok. Just hope everyone has a good one as much as possible in today's climate.

Why upload it before Christmas when he can literally make it a Christmas present by uploading on the 25th?

While I agree that Dec 25th is Christmas Day (would be foolish not to agree), in quite a few parts of the world presents are shared on the 24th, so depending on where one lives that may be when people are searching below their virtual tree.

technically the patch is done by someone third party so it might happen a day or so later.

It doesn't need updating. The same patch has been used since the game first came out and unless the dev does some major changes to the code it should stay valid until it's finished.
