As in do the exact same thing that some of his patrons did actively during these, what, one and a half years when he wasn't really active in Patreon? And what exactly did Patreon do because of these reports? Emailed him few times asking what is up and wasn't actually interested at all. They only got interested when the community guidelines breaking content was reported. They could care less if he actually gives content updates on his porn game or not when he has 7000+ patrons and Patreon gets a great cut out of that money. Smut game supporters ain't going to sue Patreon as they don't have the funds to do it, and if they would have, Patreon would just counter sue them, just like Patreon did with that one comedians supporters.
That's exactly the attitude that enabled him to pull shit like this.

People only started reporting him after the idea was first floated here. none were even aware they could and as far as I know, doesn't seem like a creator can be reported for fraud (advance apologies if I'm wrong), hence the suggestion to sue patreon because they are technically allowing fraud to happen by not monitoring such creators. therefore giving the prosecutors a stronger case.
Coming to your point about the comedian's countersuit, I don't know the exact details, but how the hell did you make this comparison? one is a comedian and another an adult game developer who has constantly lied for his own financial benefit. I'm assuming the comedian was sued for saying something offensive/controversial? that has got nothing to do with committing fraud. committing fraud can lead one to JAIL. Icstor's fraud isn't speculative, there is solid proof. Icstor has repeatedly made promises that would ensure his support continues and has failed to show otherwise.
stop with this defeatist mentality buddy or at least keep it to yourself. let the people that wanna try something, make their attempt. they can undoubtedly fail, but they can also succeed. in this case is very much possible, thanks to all the glaring errors icstor has made.
Patreon pretty much logs everything, so he won't be able to manufacture any sort of evidence to say otherwise, the only way someone would lose this is if they are really stupid and hire an even stupider lawyer.
What would you say would be his argument when asked why he made promises (on multiple occasions, not once or twice, way more than that) and never kept his word. and if he really wasn't interested in the money why the hell did he have to make promises. additionally, why didn't he pause his patreon when he knew that he wouldn't be able to keep that promise?
Patreon will not even be able to counter sue. that would only happen if the person makes unproven public comments defaming patreon and even that would only be possible if they somehow end up losing the case and icstor is declared innocent.
But even if they win, patreon risks losing too much for a mere fraudulent adult game developer. it only takes a few curious souls to go into icstor's patreon page and see for themselves the extent of his scam.
