Hello F95 users,

We wanted to clarify that the game misinterpreted. As Viznity, we are still an emerging game developer. We haven't come a long way in 2 years, as we've been trying to develop most adult play styles, including 2D and 3D. Generally, we are constantly developing prototypes and we do not publish them.

However, Viznity currently does not have an illustrator. It was not something to worry about as it is not required for 3D games. We wanted to develop a 2D game prototype from an existing asset instead of hiring an illustrator because we did not have enough budget.

Regarding this game, that's the exact same story that the artist done, animations are not from the dev etc...
I think that only the coding and (maybe) translations are original content, everything else is stolen. At the end, nothing more have been created, only stolen content and a biased Patreon button to gain money from it, that's not legit for me.
Contrary to what you said, everything is ours, except just the drawings and story. DryreL (Animation Artist) is working with us and we strive to bring Viznity to as many players as possible. Animations, sound effects, translations, game mechanics, GUI designs, coding and bug tests etc... are made by us. To say no "original content" here is to ignore all the things we do.

Since the game is no longer a prototype, we wanted to complete it and publish it to the gamers. We have sent a message to Aroma Sensei for this and we are still waiting for her reply. We also offered a job to develop a new game with her, and if she agrees, we plan to take part in a larger project that is planned to be released on Steam instead of such mini games.

I'm not sure you can call it unethical as we didn't make any profit on "Train Your Ass With Elsa". Not just its a free game on F95zone, but everywhere.

It is quite normal for you to naturally go to our Patreon page mainly, since we take care of everything except drawing. Besides, I do not agree that you call this a "theft" since her name and Patreon page are in the credits. Game development is a team work. On the contrary, it would be more appropriate to call it a "fan made" right now. It is up to you to support Aroma Sensei or Viznity. This game is a voluntary work.

Depending on Aroma Sensei's answer, the game can continue to be developed or work on a new project. She was invited to join our team and we believe that together with DryreL, Viznity will be a very strong team.

Are you actually going to argue profit doesn't make a huge difference in cases of intellectual property? Most legal systems would disagree with you if that's the case.

I don't even need to go into the argument of piracy actually promoting and resulting in more game sales (especially in the Patreon dominated, niche weg genre). The amount of succesful devs who are active on this site should speak for itself.

Edit : This discussion would be obviously off topic if the art creator is involved with this game. I hope it happens.

I truely understand what you say (as a developer myself and the difficulty of finding an artist). And you have certainly done a programming work there for sure and a really good animating work (didn't know the animator was part of the team as it's confusing).
We love H games and the more they are the happiest we are. The problem is absolutely not there.

The problem is that people coming on this topic and playing the game will love the art, and that's normal, H Elsa I'm in !
But following you they won't get more art as It's not yours.
The second problem is that you're over-promoting your Patreon with art and story completely borrowed.

If only the credits where there without PATREON logos everywhere going only to your patreon, that's "fine" and I'll be happy to see your work but in those conditions that's not legit to me..

I don't know if you understand the point ?

I don't know how you use this as justification, these two things - drawings and story - are essentially the major components of an adult game.

Your game literally would not exist without someone else's work put into the art and story. You REALLY should have gotten permission from the creator of those images before even starting to work on the game.

I do not agree that you call this a "theft" since her name and Patreon page are in the credits.
You took someone else's completed artwork without asking prior permission, slapped together a game and put a link to your own patreon in it. You can disagree all you want, but I'd say the facts speak differently.

As someone currently working to become a game dev, yall have no ground to stand on with linking to the original creator's work unless she published it with a creative commons attribution license or you got permission BEFORE using her art. Using art assets you didn't come up with is fine for prototyping and testing as long as it stays in house. As soon as you publish that game without getting permission from the original creators of assets you're using it is no longer acceptable. Yall are saying you aren't making money off this game, that's a straight up lie considering your patreon is being promoted with this. You might not be making sales but you are trying to get monetary support with this. UI and logic and whatnot are great, but the main draw for games like this are visuals and story, unless you're making a text-based game making the UI and Logic don't make a game. Also you taking her art and then inviting her to join your team is bull, if you like someone's work you make an offer to use it or have them join before you use their work. If yall seemed like you understood why people have a problem with it you'd likely get support from the community but you're just doubling down on having done nothing wrong. Yall are going to taint any future prospects if you don't pull your heads out your asses.

Well, i don't think Darksilver qualified as a multinational corporation when he was making BB
From what I know, no one ripped off his game assets. He used commercial software to create and render his game, and people simply re-created the models, from the base models that are sold/available.

That's not even close to what this game has done, which has taken complete unaltered 2D drawings without asking the author first, and pretty much only added minor 2D effects (transformations/deformations) to them.

It's one thing to use 3D models that can be altered, and needs to be posed, and which you need to use in a story you make.
It's completely different to copying a series of complete drawings / story sequence from an artist, without asking permission, wiggle them around a bit with some text and slap your patreon link on the intro screen.

I do remember that one instance where a Japanese artist agreed to have his art used in a western rpgmaker weg after it was already out. I don't think it was monetized at the time though, as Patreon milking wasn't a thing back then. Which of course makes all the difference.

It's funny how you think that putting an url in your credit section is enough to give you rights over someone else work...
Anyway, that being said, I don't find it much more different from those thousands of html games which use real porn images and gifs and got a patreon page as well.

Fucks sake dude, how unprofessional can you get? If you want to make a game with no artist you need to contract the art or at the very least get permission *before* you use the thing to promote your ghetto-ass patreon. Its hilarious that you actually expect one of the most successful porn artist around to work with a bunch of nobodies, I'm sure you're the first yokels out the woodworks to get that brilliant idea.
