can bluecat sue them?

Normally in a legal system if you broke a law to make whatever made you profit, you cannot sue someone who wronged you.I don't think he could sue for using the same assets, as those are not exclusively his, but copying his code or story, could be copy infringement. Depends on if new user made money off it though. If it's not for profit, it would be considered parody.
So if someone ripped this word for word and pic by pic and BC went into court the Ripoff would only need to get Illusion to notice the case then they would sue the shit out of BC for profiting off their Property. And BC would have no legs to sue a "thief" who stole BC's stolen property.
Yes the words are not from Illusion but they are inextricably tied to the stolen property which gave the VN profitability.
